Information Collection and Use Under the Children's Online Privacy Protection Act, no web site operator can require, as a condition to participate in an activity, that a child younger than 13 years of age disclose more information than is reasonably necessary. Just Born, Inc. (“Just Born”) complies with this requirement. Children under 13 are not permitted to join the PEEPS® Fan Club without their parent’s prior verifiable consent. To join the PEEPS® Fan Club, parents provide the child's first name, email address, gender and birth date. A parent may consent to the collection and use of a child's personally identifiable information without consenting to the disclosure of that information to third parties, unless such third parties are providing services on behalf of Just Born. If a parent consents to Just Born’s collection and use of the child’s personal information for the child’s membership in the PEEPS® Fan Club, the parent consents to his or her child participating in the following PEEPS® Fan Club activities: E-Cards Children under 13 are permitted to send an electronic card and are required only to submit their first name and e-mail address and the first name of their friend and friend's e-mail address. This information is used only for purposes of sending the electronic card, and is subsequently deleted. Promotions and Contests Children under 13 may be allowed to participate in some contests and promotions by providing their e-mail address. If a child wins the sweepstakes or contest, a notification will be sent to the child's e-mail address asking for his or her parent's e-mail address. The prize shall be awarded in the name of the parent or legal guardian. Just Born will then send an e-mail to the parent requesting contact information necessary to send the prize. If Just Born does not receive a response from the parent or legal guardian within 14 calendar days of receipt of Just Born’s email, the child (and parent/legal guardian) shall forfeit the prize. This information is used solely to conduct the sweepstakes and fulfill prizes. Downloadable Information The PEEPS® Fan Club also includes downloadable content such as Buddy Icons and Gift Tags. By providing your children’s personally identifiable information, you are also granting permission for your child to download this information from our web site. Public Forums Our web site also contains a public forum (“Official PEEPS® Message Board”) for PEEPS® Fan Club members to share their photos, recipes, crafts, memories and enthusiasm for PEEPS® products with other consumers. Anyone can view these posts, however, to submit a post, consumers must first register for the PEEPS® Fan Club, which requires prior parental consent (as explained above). Parents will be asked to create a username for their child as an identifier for the forum. The username is a unique name created by the member and should not be personally identifiable to the member. The username will be posted publicly on the Site in connection with any messages posted by the member. For the protection of all participants, these forums are monitored and all posts must be approved prior to appearing on the site for public viewing. Posts that contain inappropriate, offensive or otherwise irrelevant information to the topics categories will not be posted in the forums. Contact Us Children under 13 can submit only their e-mail address when sending an e-mail via our “Contact Us” link. Just Born uses the e-mail address to respond to a one-time request from a child under 13 and then deletes the e-mail address. Information Sharing and Disclosure Just Born does not share children's personally identifiable information with anyone, except as herein set forth. Just Born will share personally identifiable information about a child with other third parties providing services on our behalf, such as in connection with the winning of a prize or contest or when we need to send the information to companies that work on our behalf to provide a product or service that has been requested by a parent on behalf of a child. We may also disclose children's personally identifiable information in order to respond to subpoenas, court orders or legal process, to the extent permitted by law, or in the event of a merger, acquisition, bankruptcy or transfer of assets. We may also disclose your information when we determine it is necessary to comply with applicable laws or protect the interests or safety of Just Born, Fan Club Members or visitors to the Site. Unless we tell you otherwise, any companies that work on our behalf to provide a product or service do not have any right to use the personally identifiable information we provide to them beyond what is necessary to assist us. We may share aggregated demographic information with our business affiliates and advertisers. This demographic information is not linked to any personal information that can identify any individual person. Cookies Just Born may set and access "cookies" on your computer. "Cookies" are pieces of information that a web site transfers to an individual's hard drive for record-keeping purposes. Log Files Just Born uses IP addresses to analyze trends, administer the web site, track the user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Security As your child’s privacy is extremely important to us, we exercise great care in providing secure transmission of your child’s information from your computer to our servers. Unfortunately, no transmission of data over the Internet can be guaranteed to be totally secure. Therefore, we cannot guarantee or warrant the security of any information transmitted to us, and you do so at your own risk. As soon as we receive your transmission, we make our best effort to ensure its security on our systems.
