CONTEST PERIOD: The MARSHMALLOW PEEPS® DECK THE PEEPS™ Holiday Art Contest (“Contest”) is sponsored by Just Born, Inc. (the “Sponsor”).
Contest Start Date: The Contest will begin on November 17, 2011 at 9:01 AM (EST) and will run through January 5, 2012 at 11:59:59 PM (EST) (“Promotion Period”) for photo submissions and online voting. Winners will be announced on or about January 23, 2012.This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your information to Just Born, Inc. (the “Sponsor”) and not to Facebook. The information provided will only be used in the event the entrant is selected as a winner or if the entrant elects to receive additional information or promotional material from the “Sponsor”. - ELIGIBILITY: This Contest is open to all legal U.S. residents, 13 years of age or older. For participants under 13 years of age, parent/legal guardian consent is required). Employees, representatives, and agents (and persons with whom they are domiciled) of the Sponsor, its parents, affiliates, subsidiaries, advertising and promotional agencies and parties engaged in the design, development and distribution of any/all Contest materials or messaging are not eligible to participate. All Participants must agree to comply with these Official Contest Rules and Regulations. All decisions of the judges shall be considered final and binding on all Participants in all matters relating to this Contest.

HOW TO ENTER: Participants are invited to submit a photo of a creative, artistic, original work of art, including: sculpture, structure, wall art, craft, or food creation to Just Born, Inc.. Your creation must include the use of at least two (2) different types of PEEPS® Brand Candies in the design. Participants are also encouraged to incorporate other Just Born Candy products in their design, including MIKE AND IKE®, HOT TAMALES® and PEANUT CHEWS® brand candies.
To ensure a successful submission, digital photos must be uploaded in jpeg, jpg or gif file format and be no larger than 365 pixels X 265 pixels. File size should not exceed 150 KB. Only photos of creations containing PEEPS® products will be accepted. Submissions that are lewd, obscene, pornographic, disparaging, or otherwise in poor taste or inappropriate will be disqualified at the Sponsor’s sole discretion and will not be posted. By submitting a photo, you represent that you are the owner of the copyright therein and have all necessary permissions and rights as described in these Rules and Regulations.
Participants may submit more than one entry for the Contest. However, only one prize per household per family will be awarded.To enter, go to www.marshmallowpeeps.com or visit us on Facebook at http://www.facebook.com/PeepsBrand for complete online registration process details as well as information on uploading and submitting your photo. All online entries must be received by January 5, 2012 at 11:59:59 PM (EST). By submitting, you agree to the posting of the photograph for judging and for display on both www.marshmallowpeeps.com and on Facebook. Photos become the exclusive property of Just Born, Inc. to be used at its sole discretion in perpetuity.
Sponsor is not responsible for any fraudulent submissions. - PRIZE JUDGING: All entries will be initially screened by representatives of the Sponsor to assure, at its sole discretion, that there is no inappropriate content. All appropriate photos will be posted at www.marshmallowpeeps.com and displayed at http://www.facebook.com/PeepsBrand on an as-received basis commencing at 9:01 AM EST on November 17, 2011 and ending at 11:59:59 PM EST on January 5, 2012. Members of the general public will be given the opportunity to register and vote for their favorite entry. Limit one vote per person per day. Entries will be judged in two different age categories, including: under 18 years of age and 18 years of age and over. The five entries in each category with the highest number of votes at the end of the Contest at 11:59:59 PM EST on January 5, 2012 will be reviewed and judged by a panel of judges based on the following criteria (weighted equally): originality, creativity, use of PEEPS® products, adherence to holiday-theme and overall presentation. Decisions of the judges will be announced on or about January 23, 2012 and decisions of the judges are final. Ties will be broken by the judges.

One (1) First Place Prize Winner will receive a PEEPS & COMPANY® Gift Certificate for $100.00 USD, which may be applied to purchases made online at www.peepsandcompany.com or at a PEEPS & COMPANY® retail store. (ARV $100.00 USD) and a MARSHMALLOW PEEPS® Candy Prize Pack (ARV $50.00 USD). Total ARV of the First Place Prize is $150.00 USD.
One (1) Second Place Prize Winner will receive a PEEPS & COMPANY® Gift Certificate for $50.00 USD, which may be applied to purchases made online at www.peepsandcompany.com or at a PEEPS & COMPANY® retail store. (ARV $50.00 USD) and a MARSHMALLOW PEEPS® Candy Prize Pack (ARV $50.00 USD). Total ARV of the Second Place Prize is $100.00 USD.
One (1) Third Place Prize Winner will receive a MARSHMALLOW PEEPS® Candy Prize Pack (ARV $50.00 USD). Total ARV of the Third Place Prize is $50.00 USD.
18 Years of Age and Over Category:One (1) First Place Prize Winner will receive a PEEPS & COMPANY® Gift Certificate for $100.00 USD, which may be applied to purchases made online at www.peepsandcompany.com or at a PEEPS & COMPANY® retail store. (ARV $100.00 USD) and a MARSHMALLOW PEEPS® Candy Prize Pack (ARV $50.00 USD). Total ARV of the First Place Prize is $150.00 USD.
One (1) Second Place Prize Winner will receive a PEEPS & COMPANY® Gift Certificate for $50.00 USD, which may be applied to purchases made online at www.peepsandcompany.com or at a PEEPS & COMPANY® retail store. (ARV $50.00 USD ) and a MARSHMALLOW PEEPS® Candy Prize Pack (ARV $50.00 USD). Total ARV of the Second Place Prize is $100.00 USD.
One (1) Third Place Prize Winner will receive a MARSHMALLOW PEEPS® Candy Prize Pack (ARV $50.00 USD). Total ARV of the Third Place Prize is $50.00 USD.
Total ARV of all contest prizes is $600.00 (USD). Prize recipient will be subject to all terms and conditions of the PEEPS & COMPANY® gift certificate.
All photos and associated copyrights will become the exclusive property of Sponsor upon submission. Sponsor will have full rights to use all photos submitted in perpetuity. Limit one prize per household or family. - WINNER NOTIFICATION: Winners will be contacted by a representative of the Sponsor via phone and/or email. Winners will be awarded their prize via the mailing address provided on the registration form. Prizes will be distributed no later than January 31, 2012. If a prize is returned or undeliverable, that prize will be forfeited and an alternate winner will be chosen at the sole discretion of the Sponsor.
- CONDITIONS OF PARTICIPATION: Employees of Just Born, Inc., Pipeline Interactive, and their respective affiliates, subsidiaries, advertising and promotion agencies (together "Indemnities") and their immediate family members and/or those living in same household of each are not eligible to enter or vote for entries. No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute prizes of equal or greater value in the event that the prize offered is not available. Any federal, state and local taxes that may be required are the sole responsibility of the winner. All federal, state, and local laws and regulations apply. Void in Puerto Rico and where prohibited by law. If any winner is less than the age of majority in his/her state of residence, any required documents must be signed by winner’s parent/legal guardian on his/her behalf. By entering the Contest, the Participant represents and warrants that he/she owns or controls all rights, including copyrights, necessary for the posting of their submitted photos on website and gives the Sponsor the exclusive right to use, edit, or publish their entries and photographs without compensation. You warrant your entry is your sole work and that you have acquired all rights necessary (including without limitation any permissions for individuals featured in Entry photographs) and will produce these documents upon request to allow Just Born, Inc. to use your Entry as described in these Rules. You also warrant and represent that your Entry has not been previously published nor has it won previous awards and that you have obtained the written consent of any identifiable persons in the Entry Content to use their likenesses in connection with this Contest and you have obtained permission from any third party intellectual property rights holders and you will provide such permissions and accompanying documentation at Sponsor's request. Also without further compensation, winners assign all rights, title and interest in their submission to the Sponsor and, if required, will sign any documents necessary to transfer copyright. By entering the Contest and/or accepting the prize, Participants grant permission to Sponsor and their agencies to use winner’s names and/or likenesses and/or photographs for purposes of advertising/trade, without further compensation to Participants unless prohibited by law. By accepting the prize, winner agrees to hold Indemnities, their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Participants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use/redemption of any prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes. By participating in this promotion, Participants agree to be bound by the Official Rules and Regulations and the decisions of the judges whose decisions are final. Sponsor is not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to, or alterations or distortions of photos or entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest the Sponsor, in its sole discretion, reserves the right, but not the obligation to suspend modify or terminate the Contest. The Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. Caution: Any attempt by a Participant to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such Participant to the fullest extent of the law.
